appears on BBC Look North-regarding Trade Mark Infringement- "a very Common
Occurrence".
Eileen McMorrow (Principal of law firm YorSolicitor) appeared on a recent
edition of the BBC's evening news programme Look North. Eileen was asked to comment
on a case of a lady who was asked to stop making felt toy cars in the shape of
Minis and to stop using that name. Mrs. Townend's company "My Little
Car Ltd." has been contacted by BMW's solicitors and told to stop
production, as the toys infringed BMW's registered trademarks and designs.
Eileen highlighted this robust defence of a brand as "a very common
occurrence". The case "illustrates the value of intellectual
property and the value that large companies place on this group of
assets".
Eileen said that companies need to be very careful before they start using a
name (or a design) to make sure that they are not infringing a valuable
brand. Without a licence from the owner of the intellectual property, companies and
individuals can be infringing intellectual property rights. Eileen also
cautioned against registering a domain name without checking whether there is a
registered trade mark for the same (or similar) name.
