Does anyone read the small print? |
It is crucial for your business to have clear terms and conditions so that all your customers and your company have certainty when you enter into contracts together. Of course it is important that your customer has been given the opportunity to read those terms and conditions before entering into the contract- otherwise they might argue that they don't apply. Very often companies only invest money in having a comprehensive set of terms and conditions after they have encountered a problem with one of their customers. To avoid arguments as to what has been agreed between you and your customers make sure you have a good set of terms and conditions at an early stage and that any contracts incorporate your terms and conditions. It is also important to review them regularly to keep up with changes in the law. In a recent case- Regus (UK) Limited v Epcot Solutions Limited [2007], the High Court held that the supplier of services could not rely on an exclusion clause which attempted to exclude liability for financial loss. It is very important to look particularly at liability clauses and make informed commercial decisions about how these might work in practice.

Eileen McMorrow visits Bio2007 with trade mission from Yorkshire |
Eileen McMorrow, principal solicitor of YorSolicitor attended Bio2007 in Boston USA. This is an annual biotechnology showcase which was attended by over 22,000 delegates this year.
Bio2007 represented more than 1,100 biotechnology companies, academic institutions, state biotechnology centres and related organisations across the United States and 31 other nations. Eileen attended the event as part of the UK Trade and Investment (UKTI) Yorkshire and Humberside Mission. The mission was supported by Yorkshire Forward's Targeted Export Support Scheme.
Eileen said "I made contact with other service providers particularly law firms in the US and other countries. This will be invaluable when my clients wish to do business overseas as I have ready points of contact to assist them with legal issues in different countries."
